Former Federal Bureau of Investigation Employee Alleges Wrongful Dismissal Because of Pride Symbol Display

A long-serving Federal Bureau of Investigation operative has initiated a legal case alleging his dismissed for displaying an LGBTQ+ banner within his desk area.

As per David Maltinsky, that worked with the bureau since 2009, the termination recently is being described as “unconstitutional and politically motivated”.

Legal Case Asserts Constitutional Violations

The legal filing contends that the FBI infringed upon Maltinsky’s First Amendment protections and took disciplinary action toward him due to engaging in protected speech.

The former specialist is asking for a legal ruling to return his position at the bureau.

Details of the Lawsuit

The 18-page filing, filed in the US district court for the District of Columbia, alleges that the plaintiff was dismissed from the Quantico facility recently over previously exhibiting the Pride symbol in his workspace.

Per the complaint, the rainbow symbol was given to the employee in recognition of his efforts to promote the FBI’s inclusion programs.

Since childhood, my goal was to serve the United States and ensure the nation’s safety beside the talented and committed personnel of the FBI,” said the plaintiff.

He added, “I displayed that Pride flag – that previously flew in front of the Wilshire federal building – not as a political statement, but as a symbol of acceptance, solidarity and impartial service.

These ideals that once made the bureau effective. Now it is a place where individuals such as myself are singled out. I believe I was fired not on account of who I am, but rather because of what I represent: a proud gay man,” he said.

Unexpected Termination Just ahead of Completion

In the past months, Maltinsky was accepted into the bureau’s agent course at the FBI facility, until what he called “sudden termination only weeks prior to graduation”.

The lawsuit additionally states that eventually subsequent to the 2017 inauguration, another employee raised an issue to the overseeing official about the exhibition of the Pride flag.

As a precaution, Maltinsky sought that the Chief Division Counsel for the Los Angeles field office assess whether the exhibition of the symbol was allowed,” the filing noted.

It further mentioned, “The Chief Division Counsel advised the employee that exhibiting of the flag was not against any bureau guidelines.”

Informing of Dismissal

Nevertheless, on the first of October, the employee received notice of his termination.

In correspondence referenced in the complaint, agency head the official stated, “I have determined that you exercised poor judgment with the presence of political signage at your workstation during your previous assignment at the Los Angeles Field Office.

“Pursuant to federal law of the U.S. Constitution, and the laws of the United States, your position with the Federal Bureau of Investigation is concluded.”

Attorney Comment

In comments provided recently, Maltinsky’s lawyer his counsel said, “This administration’s unlawfully firing him forms part of a broader effort to purge government departments of employees with alternative perspectives, or are from minority populations, or individuals that challenge discrimination.

His case is not just about him, but also about ensuring the liberties and protections of every government worker.”

Bureau Response

The FBI refused to respond about the legal action.

Maltinsky’s lawsuit is subsequent to another one submitted earlier by previous high-level bureau employees who said they had been improperly dismissed.

They alleged that the director claimed he was ordered by the administration to dismiss any employee associated with a probe into Trump.

Meanwhile, the bureau dismissed an experienced official in November after the official was said to be angered over news that the FBI director had taken a government jet to go to a match at which his companion rendered the national anthem.

Steven Palmer, an FBI employee since 1998, was fired as head of the agency’s response team, that handles serious incidents and the bureau’s aircraft.
